The Advisor will report to the General Director of ACS and will be based in the Province of Sofala - Dondo.

YOUR NEXT CHALLENGE

The legal advisor responsible for ACS is part of the AMWA legal team. As Legal Counsel, you will be responsible for overseeing all legal matters related to our operations at ACS. The Advisor will provide legal guidance, manage legal risks and ensure compliance with relevant laws and regulations. The Advisor will work closely with AMWA and Group legal and compliance functions, internal stakeholders, including executives at country, regional and area levels to protect the legal interests of our operations at ACS and help achieve the objectives of business.

Main responsibilities

  • Legal advice: Providing specialist legal advice on a wide range of issues, including contracts, licensing, land issues, employment, corporate governance, regulatory compliance and litigation matters.

  • Contract management: Draft, review and negotiate a variety of contracts, agreements and legal documents that arise from the day-to-day business of ACS operations, ensuring they are aligned with Heidelberg Materials Group policies and objectives .

  • Compliance: Monitor changes in laws and regulations that affect ACS operations and ensure compliance with all applicable legal requirements.

  • Risk Management: Identify and assess legal risks associated with business activities and develop strategies to mitigate potential liabilities.

  • Reports: quarterly legal reports relating to ongoing legal matters at ACS; creation and regular updating of the list of disputes.

  • Litigation Management: Manage all legal disputes and contentious matters involving ACS, including liaising with external counsel as necessary.

  • Contact with external lawyers: In coordination with the legal function of the Area, collaborate with external law firms or specialized lawyers when complex legal issues arise. This involves :

  1. Select and hire outside counsel based on their experience and the specific legal issue.

  2. Clearly communicate objectives, requirements and expectations to external counsel.

  3. Monitor the progress of external consultancy work, ensuring its alignment with the defined goals and budget.

  4. Maintain open lines of communication with outside counsel to provide guidance, respond to questions, and ensure a coordinated approach to legal matters.

  5. Negotiating fee agreements and managing legal costs to optimize resources.

  • Corporate Governance: collaborate with the company secretariat to ensure compliance with corporate governance principles.

  • Materials Group policies and procedures to ensure legal compliance and best practices.

  • Regulatory Affairs: Interact with regulatory bodies and government agencies to address regulatory issues and secure necessary licenses or approvals.
REQUIREMENTS
  • Law degree from an accredited law school; A Master's degree in Law is an advantage.

  • Admission to the Bar Association in Mozambique.

  • 10 years of experience as a lawyer, with a preference of 2 to 3 years of corporate in-house legal experience.

  • Strong knowledge of construction materials regulations and laws in Mozambique.

  • Excellent negotiation, communication and interpersonal skills.

  • Ability to work independently, make sound decisions and deal with confidential information.

  • Strong organizational and project management skills.

  • The position requires fluency in English.
